These terms of use ("Terms of Use") apply to your use of the RH.com website and any other "Restoration Hardware" or "RH" websites that we own and control and which contain a link to these Terms of Use ("Websites").The Websites are referred to as "Sites" in these Terms of Use. The Sites are operated by RH London Gallery Limited ("We").
We are registered in England and Wales under company number 12038769 and have our registered office at C/O Intertrust (UK), 1 Bartholomew Lane, London, United Kingdom EC2N2AX.

By using any of our Sites, you confirm that you accept these Terms of Use and that you agree to comply with them.

We may make changes to these Terms of Use
We may change these Terms of Use from time to time. When we make changes we will post a revised version of the Terms of Use on the Sites. Any such changes will become effective on the "Last Updated" date indicated above and such changes will not apply to any dispute between you and us arising before such date on which the revised version of the Terms of Use incorporating such changes became effective. Please check the Terms of Use every time you use our Sites to make sure you understand the terms that apply at the time.
Your continued use of the Sites following any changes to the Terms of Use will constitute your acceptance of such changes. The "Last Updated" legend above indicates when the Terms of Use were last changed.
We may make changes to the Sites
We may, at any time, modify or discontinue all or part of the Sites (including access via any third-party links) to reflect changes to our products and services.
The use of our Sites is free of charge, but we have a Members Program, which you can join for a fee. The members program is subject to additional Terms and Conditions and any offer or promotion will be subject to additional terms and conditions that will be made available to you at the relevant time.
We may suspend or withdraw any of our Sites
We do not guarantee that our Sites, or any content on them, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Sites for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
You are also responsible for ensuring that all persons who access our Sites through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.
Compliance with laws and geographical restrictions
Our Sites are directed to people residing in England OR the United Kingdom. We do not represent that content available on or through our Sites are appropriate for use or available in other locations.
Our products and third party products
The Sites may make available listings, descriptions and images of goods or services or related coupons or discounts (collectively, "Products"), as well as references and links to Products. Such Products may be made available by us or by third parties. The availability through the Sites of any listing, description or image of a third party Product is for general information only and does not imply our endorsement of such Product or affiliation with the provider of such Product. Although we make reasonable efforts to update the listing, description and image of any third party Product on our Sites, we make no representations as to the completeness, accuracy or timeliness of such listings, descriptions or images (including any features, specifications and prices contained therein).
Transactions
We may make available the ability to purchase or otherwise obtain certain Products through the Sites or through other sales channels such as telephone orders, mail orders or our physical stores (a "Transaction"). If you wish to make a Transaction, you may be asked to supply certain relevant information, such as your credit card number and its expiration date, your billing address and your shipping information ("Payment Information"). YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT TO USE ANY CREDIT CARD THAT YOU SUBMIT IN CONNECTION WITH A TRANSACTION. By submitting such information, you grant us the right to provide such information to third parties for purposes of facilitating Transactions. Verification of information may be required prior to the acknowledgment or completion of any Transaction. You agree to pay all charges incurred by you or on your behalf through the Sites, at the prices in effect when such charges are incurred, including all shipping and handling charges. In addition, you are responsible for any taxes applicable to your Transactions. While it is our practice to confirm orders by email, the receipt of an email order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a product or service.
We and our third party payment service providers may request, and may receive from any of your payment card issuers or any payment card network, updated payment card information, such as cancellation of any payment card account, or updated payment card numbers or expiration dates. If such updated information is provided to us and/or any of our third party payment service providers, we may use that information to process any payment that you have authorized us to charge to such payment card, including payment for any outstanding balances owed by you on any purchase. By using the Sites and accepting these Terms of Use, you hereby authorize RH and its third party payment service providers to update your payment card information and charge your payment card using any such updated payment card information. Your payment card issuer may allow you to opt out of providing updated card information. For more information, please contact your payment card issuer.
Restrictions. RH reserves the right, including without prior notice, to limit the available quantity of or discontinue making available any Product; to impose conditions on the honoring of any coupon, discount or similar promotion; to bar any user from making any Transaction; to cancel any Transaction even after it has been placed online through the Sites, via customer service, in a Gallery, and/or in an Outlet, and to refuse to provide any user with any Product. By making a Transaction, you represent that the applicable Products will be used only in a lawful manner. You agree that you will not resell any products or services obtained through a Transaction, unless we have provided our express prior written consent for you to do so.
Consent Agreement for Storing Payment Information. You agree that we may store your Payment Information following your completion of a Transaction. We will only use Payment Information to finalize complete payment for any Product purchased online through the Sites, via customer service, in a Gallery, and/or in an Outlet and/or to facilitate future Transactions you may initiate through the Sites. You may withdraw your consent permitting RH to store your Payment Information by adjusting your settings in "My Account".
Sales terms and conditions
Returns & Exchanges. Returns and exchanges of Products will be subject to RH's applicable returns and exchange policies. The returns and exchange policy for Transactions made through https://rh.com/gb/en is available at https://rh.com/gb/en/customer-experience/return-policy.
Shipping. RH offers shipping services subject to RH's applicable shipping policies. The shipping policy for Transactions made through https://rh.com/gb/en is available at https://rh.com/gb/en/customer-experience/shipping-and-delivery.
Trade Customers; Contract Customers. If you are a trade customer, then, in addition to the Terms of Use, the Trade Terms & Conditions will apply to you and your Transactions as a trade customer; such additional terms and conditions will be made available in connection with the registration process for trade customers. If you are a contract customer as determined by RH, then, in addition to these Terms of Us, the Contract Terms & Conditions will apply to you and your Transactions as a contract customer; such additional terms and conditions will be made available in connection with the registration process for contract customers.
To the extent of any conflict between any of the provisions of these Terms of Use and those of the Trade Terms & Conditions or the Contract Terms & Conditions (as appropriate), those of the Trade Terms & Conditions or the Contract Terms & Conditions (as appropriate) will govern.
Registration; User Names and Passwords
You may need to register to use all or part of any of our Sites. We may reject, or require that you change, any user name, password or other information that you provide to us in registering. Your user name and password are for your personal use only and should be kept confidential and you should not disclose it to any third party; you, and not us, are responsible for any use or misuse of your user name or password, and you must promptly notify us of any confidentiality breach or unauthorized use of your user name, password or account for any of our Sites.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at CustomerExperience.UK@RH.com.
Rules of Conduct – How you may use our Sites
In connection with the Sites, you must not:
Post, transmit or otherwise make available through or in connection with the Sites any materials that are or may be: (a) threatening, harassing, degrading, hateful or intimidating, or otherwise fail to respect the rights and dignity of others; (b) defamatory, libelous, fraudulent or offensive; (c) obscene, indecent, pornographic or otherwise objectionable; or (d) protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner.
Post, transmit or otherwise make available through or in connection with the Sites any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment.
Use any of our Sites in a manner, or for any purpose, that is fraudulent or unlawful or in any manner inconsistent with these Terms of Use, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into any operating system.
Harvest or collect information or data from any of our Sites.
Interfere with or disrupt the operation of the Sites or the servers or networks used to make the Sites available, including by hacking or defacing any portion of the Sites, or violate any requirement, procedure or policy of such servers or networks.
Restrict or inhibit any other person from using the Sites.
Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of (or any use of) the Sites except as expressly authorized herein, without our express prior written consent.
Reverse engineer, decompile or disassemble any portion of the Sites, except where such restriction is expressly prohibited by applicable law.
Remove any copyright, trademark or other proprietary rights notice from the Sites.
Frame or mirror any portion of the Sites, or otherwise incorporate any portion of the Sites into any product or service, without our express prior written consent.
Systematically download and store content from any of our Sites.
Conduct, facilitate, authorize or permit any text or data mining or web scraping in relation to any of our Site or any services provided via, or in relation to, any of our Sites. This includes using (or permitting, authorizing or attempting the use of):
any robot, spider, site search/retrieval application or other manual or automatic device tool, algorithm, code, process or methodology to access, obtain, copy, monitor, republish, retrieve, index, "scrape", "data mine" or otherwise gather any portion of the Sites or any content, data or information assessed via the Sites, or reproduce or circumvent the navigational structure or presentation of the Sites, without our express prior written consent;
any automated analytical technique aimed at analyzing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations,
but this clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
Notwithstanding the foregoing, and subject to compliance with any instructions posted in the robots.txt file located in the Sites' root directories, we grant to the operators of public search engines permission to use spiders to copy materials from the Sites for the sole purpose of (and solely to the extent necessary for) creating publicly available, searchable indices of such materials, but not caches or archives of such materials. We reserve the right to revoke such permission either generally or in specific cases, at any time and without notice.
If you print off, copy, download, share or repost any part of our Sites in breach of these Terms of Use, your right to use our Sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. By continuing to access, view or make use of any of our Sites, you hereby warrant and represent to us that you are located in England OR the United Kingdom. You are responsible for obtaining, maintaining and paying for all hardware and all telecommunications and other services needed to use the Sites.
Limited License
Subject to your compliance with these Terms of Use, and solely for so long as you are permitted by us to use the Sites, you may view one (1) copy of any portion of the Sites to which we provide you access hereunder, on any single device, solely for your personal, non-commercial use.
Our Proprietary Rights
Our trade names, trademarks and service marks, among others, include RH, RESTORATION HARDWARE, RH BABY & CHILD, RH TEEN, RH MODERN, RH BEACH HOUSE and any associated logos. All trade names, trademarks, service marks and logos on the Sites not owned by us are the property of their respective owners. You may not use our trade names, trademarks, service marks or logos in connection with any product or service that is not ours, or in any manner that is likely to cause confusion. Nothing contained on the Sites should be construed as granting any right to use any trade names, trademarks, service marks or logos without the express prior written consent of the owner.
We are not responsible for websites we link to
Where any of our Sites contain links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.
We have no control over the contents of those sites or resources.
Disclaimer of warranties and our responsibility for loss or damage suffered by you
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any Products to you, which will be set out in our sales terms and conditions.
We are not responsible for events outside our control.
Please note that we only provide our Sites for domestic and private use. You agree not to use our Sites for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We are not liable for losses you suffer caused by us breaking these Terms of Use if your loss is:
Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
Caused by a delaying event outside our control.
Avoidable. Something you could have avoided by taking reasonable action.
If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
We are not responsible for viruses and you must not introduce them
We are not responsible for viruses and you must not introduce them.
We do not guarantee that our Sites will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.
You must not misuse any of our Sites by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our Sites, the server on which our Sites are stored or any server, computer or database connected to our Sites. You must not attack our Sites via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Sites will cease immediately.
Rules about linking to our Sites
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to any of our Sites in any website that is not owned by you.
Our Sites must not be framed on any other site, nor may you create a link to any part of our Sites other than the home page.
We reserve the right to withdraw linking permission without notice.
The website in which you are linking must comply in all respects with the content standards set out in the Terms of Use.

We may transfer this agreement to someone else
We may transfer our rights and obligations under these Terms of Use to another organization. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Terms of Use.
You need our consent to transfer your rights to someone else
You may only transfer your rights or your obligations under these Terms of Use to another person if we agree in writing.
No rights for third parties
These Terms of Use do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provisions of these Terms of Use.
If a court finds part of this contract illegal, the rest will continue in force
Each of the paragraphs of these Terms of Use operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing this contract, we can still enforce it later
Even if we delay in enforcing these Terms of Use, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms of Use, or if we delay in taking steps against you in respect of you breaking these Terms of Use, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
Which country's laws apply to any disputes?
If you are a consumer, please note that these Terms of Use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
If you are a business, these Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
